Welcome to WhalePhone. This agreement is between you and Whaletech AI ("we") about your use of the WhalePhone app and its services. Tapping "Agree and continue" on first run means you have read and agree to this agreement and the Privacy Policy. If you do not agree, please do not use WhalePhone.

1. The service

  1. WhalePhone is an assistant that works your phone for you: you say what you need in a sentence, and Whale opens apps, taps and types on a screen only it can see, then tells you the result.
  2. This is a test build. Features may change, tasks may fail or go wrong, and the service may be interrupted. We do our best, but promise no completion rate or availability.
  3. WhalePhone needs system permissions such as the accessibility service and overlays to work; what each is for is in the Privacy Policy.

2. Your account

  1. You need to sign in to use WhalePhone. Keep your sign-in credentials safe; actions under your account count as yours.
  2. You can contact us to cancel your account; we handle it within 15 working days.

3. Acceptable use

You agree not to use WhalePhone to:

  1. break the law or infringe anyone's rights;
  2. operate accounts, devices or data that are not yours without authorisation;
  3. harass anyone (for example by using an auto-reply rule to send someone many messages);
  4. get around the safety mechanisms of any app or platform.

If you do, we may suspend or end the service.

4. Automation carries risk, and the actions are yours

  1. Whale really acts inside your accounts. The apps it opens, the messages it sends and the orders it places are made in your name. Use it only where you trust it and on screens you are willing to let it see.
  2. For irreversible actions such as payments, deletions and sending sensitive content to others, Whale stops and hands back to you for confirmation; do not confirm what you have not read.
  3. The standing rules you set (such as "reply to anyone who messages me") act for you while you are away, and the consequences are yours. Give rules a sensible window and scope, and cancel them when you no longer need them.
  4. The model's judgement can be wrong. Treat the real state inside the app as the truth, not Whale's report of it.

5. Intellectual property

The WhalePhone app, its name, marks and content belong to us. The rules, task descriptions and conversations you create belong to you.

6. Disclaimer and limitation of liability

To the extent the law allows: WhalePhone is provided as is; we are not liable for indirect losses from using it; and we are not liable for unavailability caused by force majeure or by changes or outages of third-party services (including model, speech, sign-in and storage services).

7. Changes and termination

We may revise this agreement and will tell you in the app. Continuing to use WhalePhone after a revision means you accept it. You can stop using WhalePhone and uninstall it at any time.

8. Governing law

This agreement is governed by the laws of the People's Republic of China. Disputes are first settled by friendly negotiation, failing which by the competent people's court where we are located.
